1. Acceptance of Terms
By accessing, browsing, registering for, or using the Pravaasa Stays platform (the 'Platform'), you agree to comply with and be bound by these Terms & Conditions ('Terms'), our Privacy Policy, and all referenced policies.
If you do not agree with any part of these Terms, you must discontinue use of the Platform immediately. Additional terms may apply to specific services, bookings, or host features, and will be presented at the point of interaction.
2. About Pravaasa Stays & Platform Intermediary Role
Pravaasa Stays is an independent technology platform and marketplace intermediary connecting prospective guests ('Guests') with independent accommodation hosts, property owners, and managers ('Hosts').
IMPORTANT CLARIFICATION: Pravaasa Stays does not own, manage, lease, operate, or furnish the properties listed on the Platform, unless explicitly and visibly stated on the specific property listing. When a Guest books a stay, the accommodation contract is formed directly between the Guest and the Host. Pravaasa Stays acts strictly as an intermediary marketplace and technology facilitator.
3. Eligibility & User Accounts
You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to create an account, list a property, or make a reservation on Pravaasa Stays.
You are responsible for maintaining the confidentiality of your authentication credentials, whether phone OTP, email magic link, or third-party sign-in. You must notify Pravaasa Stays promptly if you suspect unauthorized access to your account.
All information provided during registration, booking, or hosting must be accurate, current, and complete.
4. Guest & Host Roles and Responsibilities
4.1 Guest Obligations
Guests agree to treat properties, hosts, neighbors, and staff with mutual respect and dignity.
Guests must abide by all house rules disclosed on the listing at the time of booking, including check-in/check-out times, maximum occupancy limits, quiet hours, pet restrictions, and smoking rules.
Guests are responsible for their own actions and the actions of all individuals in their party.
4.2 Host Obligations
Hosts represent and warrant that they possess the legal right, ownership, lease authorization, or operational mandate to list the property.
Hosts must deliver the accommodation as described in their listing, ensuring it is clean, safe, accessible, and in working condition for confirmed reservations.
Hosts must honor confirmed pricing and booking dates without requesting unauthorized surcharges outside the Platform.
5. Booking Process, Availability & Pricing
When you submit a reservation request or complete an Instant Booking, your reservation is confirmed once payment authorization is completed and a formal confirmation reference is issued.
All rates displayed are determined directly by the Host, inclusive or exclusive of mandatory statutory taxes as stated on the breakdown summary prior to payment.
While Pravaasa Stays strives to keep calendar availability accurate, all calendars depend on Host management and multi-channel synchronization.
6. Cancellations & Refunds
Every property listing clearly displays the Host's selected Cancellation Policy prior to booking. The applicable terms govern whether a cancellation qualifies for a full refund, partial refund, or non-refundable forfeit.
Refund requests resulting from Host cancellation, duplicate billing, or verified platform errors will be processed back to the original payment method in accordance with our Refund Policy.
7. Conduct, Reviews & Prohibited Activities
Users may not engage in fraudulent, illegal, abusive, defamatory, or disruptive conduct on or through the Platform.
Reviews and ratings submitted must reflect authentic, firsthand personal experiences. Review extortion, manufactured ratings, and retaliatory reviews are strictly prohibited.
Any violation of our Prohibited Properties & Activities Policy may result in immediate suspension, listing removal, and referral to relevant authorities.
8. Intellectual Property
The Pravaasa Stays name, brand marks, logo, website architecture, visual design, and software code are proprietary assets protected under intellectual property laws.
Hosts retain ownership of the photos and descriptions they upload, but grant Pravaasa Stays a non-exclusive, worldwide, royalty-free license to display, optimize, and market the listing on the Platform.
9. Disclaimers & Limitation of Liability
THE PLATFORM IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRAVAASA STAYS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, AND UNINTERRUPTED AVAILABILITY.
IN NO EVENT SHALL PRAVAASA STAYS BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, NOR FOR PERSONAL INJURY, PROPERTY DAMAGE, THEFT, OR HOST DEFAULT ARISING FROM ANY ACCOMMODATION STAY.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any legal dispute, controversy, or claim arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts in Bengaluru, Karnataka, India.
Parties agree to first attempt informal resolution through Pravaasa Stays Customer Support before initiating formal legal proceedings.
